A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.

Practical effect: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.

GST on fertilisers cut to five per cent on the eve of rollout

Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.

Why this matters: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.

What is the due date for GSTR-3B in Tamil Nadu?
For monthly filers, GSTR-3B is due on the 20th of the following month. If you are registered in Tamil Nadu and have opted for the QRMP scheme, your quarterly GSTR-3B is due on the 22nd of the month following the quarter. GSTR-3B is the summary return through which you actually pay tax, so missing it attracts a late fee of Rs.50 per day (Rs.20 for nil returns) plus interest at 18 percent per annum on tax paid late.
What is GSTR-2B and why does my consultant match it before filing?
GSTR-2B is an auto-drafted statement of the input tax credit available to you, generated on the 14th of every month from the GSTR-1 and IFF filings of your suppliers. Input tax credit in GSTR-3B can only be claimed for invoices appearing in GSTR-2B, so matching your purchase register against it before filing is essential. My supplier is delivering one order in several instalments. When can I claim the ITC?

It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. How is GST charged on clothes and footwear after the rate change?
The rate now turns on a per-piece price line of Rs.2,500. For unregistered clients, the place of supply is where the event is actually held. Admission tickets are taxed where the event takes place. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
