Recognising that large suppliers needed time to configure their billing systems, CBIC waived the penalty under Section 125 for failure to comply with the dynamic QR code requirement on business-to-consumer invoices issued between 1 December 2020 and 31 March 2021. The waiver was conditional on the supplier complying with the requirement from 1 April 2021 onwards. Similar conditional waivers were issued in later years as the deadline was pushed further.

To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office. Applicants aggrieved by improper queries, unjustified rejection or delay may write to that address with the application reference number; the zone must examine the grievance, take corrective action and report the disposal to the Directorate General of GST periodically.
What to do about it: A registration rejected on flimsy grounds need not go straight to appeal; the zonal grievance email often gets the application reopened far faster.
Maharashtra State Power Generation Co Ltd — AAR Maharashtra, Order No. GST-ARA-15/2017/B-30, dated 8 May 2018 (upheld by AAAR) · 2018-05-08
The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
Why this matters: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
