A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Why this matters: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

What it means for you: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

Which input tax credits are blocked under Section 17(5) even if they appear in GSTR-2B?
Section 17(5) blocks credit on specified items regardless of business use: motor vehicles for passenger transport with seating up to thirteen persons, unless used for resale, passenger transport or driver training; food and beverages and outdoor catering; club and fitness memberships; life and health insurance except where statutorily obligatory; works contract and construction services for immovable property other than plant and machinery; goods lost, stolen, destroyed, written off or given as gifts and free samples; and tax paid under composition. If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise. A hardware store in Injambakkam can bill cement at 18 percent and certain tools at 5 percent on one document. Transfer of development rights and long-term leases to promoters are also covered.
