The Supreme Court held that a rule prescribing a period within which credit must be taken from the date of the invoice does not take away any vested right. It merely regulates the manner and time of availing the credit, which the legislature is entitled to do. A taxpayer who fails to take the credit within the prescribed window loses the benefit. This reasoning supports the time limit in Section 16(4) of the CGST Act.
Practical effect: Chennai businesses should reconcile purchase registers with GSTR-2B every month and claim credit within the deadline, as belated claims are generally lost.

This notification exempts from obtaining registration those persons who supply only goods or services on which the entire tax is payable by the recipient under reverse charge in terms of section 9(3) of the CGST Act. Typical beneficiaries are small goods transport agencies, individual advocates, and persons supplying only notified reverse charge items, because the recipient discharges the tax and the supplier has no output liability to report.
What to do about it: A Chennai transporter or advocate whose entire turnover is covered by reverse charge need not take GST registration, however genuinely mixed turnover destroys this exemption.

CBIC clarified that where a manufacturer replaces parts or provides repair services free of cost during the warranty period, no further GST is payable because the value of the warranty was already included in the price of the original supply on which tax was paid. Consequently the manufacturer need not reverse input tax credit on such replacement parts. Where a distributor replaces parts from his own stock and is reimbursed through a credit note, the position was explained separately.
What to do about it: Manufacturers and dealers should not pay GST again on warranty replacements, and should resist ITC reversal demands raised on free-of-cost warranty issues.
