The department demanded interest on the entire tax shown in belated GSTR-3B returns, including the part discharged from input tax credit. The Madras High Court held that interest under Section 50 is compensatory, and can be levied only on the belated cash payment of tax, not on input tax credit that was lying with the department all along. The proviso inserted in Section 50(1) was treated as curative and applicable to earlier periods as well.

GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31
GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.

The Uttar Pradesh Authority for Advance Ruling held that expenditure incurred to discharge corporate social responsibility obligations under Section 135 of the Companies Act, 2013 is incurred in the course or furtherance of business, so input tax credit on such goods and services was available. Parliament reversed this position by inserting clause (fa) in Section 17(5) of the CGST Act through the Finance Act, 2023, which blocks credit on goods or services used for CSR activities with effect from 1 October 2023.
What it means for you: Credit on CSR spending is available only for periods before 1 October 2023; reverse or avoid such credit for later periods to prevent interest and penalty.
