CBIC clarified that an electronic commerce operator liable to pay tax under Section 9(5), for notified services such as passenger transport, restaurant supplies and housekeeping booked through its platform, must discharge that liability entirely through the electronic cash ledger. At the same time, the operator is not required to reverse input tax credit on its own inputs and input services proportionate to such Section 9(5) supplies; that credit remains available for tax on its own platform services.
Practical effect: Platform operators should pay Section 9(5) liability in cash while retaining full credit for their own costs, and restaurants selling through apps should confirm the operator is discharging that tax.
GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31
GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.
What it means for you: Maintain a running register of credit reversed and reclaimed, because the portal flags excess reclaims and the data feeds departmental scrutiny.

Meeting shortly after the Kerala floods, the Council discussed that State's proposal to impose a cess on SGST to fund rehabilitation and flood-related works. Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.
What it means for you: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
