I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Kattupakkam as urgent.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. What imprisonment terms does GST law prescribe, and which offences are non-bailable?

At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
Can a compliance review actually prevent GST notices?
Largely, yes. Most notices arise from mismatches the portal detects automatically: GSTR-1 versus GSTR-3B tax differences, ITC claimed beyond GSTR-2B, e-way bill turnover gaps and unfiled returns. A periodic review catches these before the system does, so you can correct them through amendments in subsequent returns or a voluntary DRC-03 payment with interest, which under Section 73 attracts no penalty and no notice for the amount paid. What a review cannot prevent are genuine interpretation disputes, but even there it prepares your documentation in advance. What is the difference between a Section 73 and a Section 74 notice?

What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. What is the default place of supply rule for services within India?
Section 12(2) of the IGST Act sets the general rule for domestic services: if the recipient is registered, the place of supply is the recipient's location; if unregistered, it is the recipient's address on your records, and failing that, the supplier's own location.
