Past periods were regularised on an as-is-where-is basis to prevent retrospective demands.
Practical effect: Food processors and building-material traders should re-check product classifications against this circular, since regularisation protects past periods but the clarified rates bind future supplies.
Notification No. 2/2022-Central Tax (Rate), dated 31 March 2022 · 2022-03-31
From 1 April 2022 fly ash bricks and blocks, building bricks, bricks of fossil meals and earthen or roofing tiles moved to twelve per cent with input tax credit under the main schedule, with this notification offering an alternative six per cent rate on condition that no input tax credit is taken on inputs, input services or capital goods. Brick manufacturers were simultaneously moved to a lower registration threshold and taken out of the ordinary composition scheme.
What to do about it: A brick kiln near Chennai must consciously elect between six per cent without credit and twelve per cent with credit, and the choice should be worked out on its actual input tax cost.

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.
What to do about it: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.
