The Board answered a set of service taxability questions arising from the 52nd GST Council meeting. Among them, it confirmed that District Mineral Foundation Trusts set up by State Governments qualify as Governmental Authorities and are therefore eligible for the exemptions available to such authorities. The Karnataka AAR examined which income streams of an individual count towards aggregate turnover for GST registration. It held that salary received as an executive, full-time director is outside the ambit of GST and not includable in aggregate turnover. In contrast, remuneration of a non-executive director is a taxable service, and such amounts, along with partner's salary from a firm, interest income and rental income — including residential rent that is itself exempt — must be counted when testing the registration threshold.
What to do about it: Individuals with mixed income should compute the GST registration threshold carefully, excluding employee salary but including non-executive director fees and rentals.

The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.
Practical effect: Electric vehicle dealers and charging point operators in Chennai bill at five per cent, a rate that has survived every later rate revision including GST 2.0.
