Bharat Mint and Allied Chemicals v. Commissioner, Commercial Tax — Allahabad High Court, Writ Tax No. 1029 of 2021, decided 4 March 2022 · 2022-03-04

An adverse order was passed after the taxpayer marked 'No' in the personal hearing column of the reply form. The High Court held that under Section 75(4) an opportunity of personal hearing must be granted wherever a request is received or where an adverse decision is contemplated. Since the order was adverse, a hearing was mandatory irrespective of whether it was requested. The order was quashed and the matter remitted for a fresh decision after hearing.

The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?

I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
What is the GST rate for salons, gyms and yoga centres?
From 22 September 2025, beauty and physical well-being services, covering salons, barbers, beauty parlours, gyms, fitness centres and yoga institutes, attract 5 percent GST without input tax credit, reduced from the earlier 18 percent. The condition attached to the concessional rate is important: because credit is barred, the GST paid on your rent, equipment, cosmetics and consumables becomes part of your cost base.
