From the October 2025 tax period, credit notes can be kept pending for one tax period and the recipient can declare the ITC reversal amount while accepting a credit note. Read with Rule 67B, a supplier's output liability reduction is linked to the recipient's action, with reversal required only where credit was actually availed.
Why this matters: Someone in the business must act on IMS records each month before GSTR-2B generation, because unattended rejections and credit notes now directly move both parties' tax positions.
LC Infra Projects (P) Ltd v. Union of India — Karnataka High Court, judgment dated 22 July 2019 · 2019-07-22
The department demanded interest for delayed payment of tax and attached the taxpayer's bank account without first issuing any show cause notice. The High Court held that issuance of a show cause notice is a mandatory pre-condition before recovery of interest, because the taxpayer must have an opportunity to dispute the period and the computation. The recovery action and the bank attachment were quashed, with liberty to the department to proceed afresh after proper notice.
Practical effect: Interest cannot be lifted from your bank account without warning — insist on a show cause notice and a chance to verify the calculation.
GSTN Advisories dated 11 April 2025 and 16 May 2025 — Table 3.2 of GSTR-3B · 2025-04-11
GSTN first advised that from the April 2025 period, auto-populated values in Table 3.2 of GSTR-3B, covering inter-state supplies to unregistered persons, composition taxpayers and UIN holders, would become non-editable, with corrections routed through GSTR-1A. After taxpayer representations, a 16 May 2025 advisory kept Table 3.2 editable for the time being. The locking was later subsumed in the broader hard-locking of GSTR-3B liability during 2025.
What it means for you: Report place-of-supply details correctly in GSTR-1 itself, since state-wise B2C figures in GSTR-3B are moving beyond manual correction.
