Circular No. 235/29/2024-GST, dated 11 October 2024 · 2024-10-11

Implementing the 54th GST Council decisions, CBIC clarified that extruded or expanded savoury or salted products other than un-fried snack pellets fall under tariff item 1905 90 30 and attract twelve per cent prospectively, while un-fried or uncooked snack pellets continue at five per cent. Roof-mounted package unit air conditioning machines for railway coaches were held classifiable under heading 8415 and not as railway parts, and the rate position on motor car seats was settled.

Entry 66, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

Entry 66 exempts services supplied by an educational institution to its students, faculty and staff, and services relating to admission to or conduct of examinations. It also exempts transportation of students, catering including any government-sponsored mid-day meal scheme, security, cleaning and housekeeping supplied to an institution, but only where that institution provides education up to higher secondary level. An educational institution is one whose output leads to a qualification recognised by law, so private coaching classes fall outside the exemption.

Practical effect: A Chennai coaching centre or competitive-exam institute is fully taxable, while a recognised school or college is exempt, and the two must never be treated alike.

The department provisionally attached the taxpayer's bank accounts and stock under Section 83 during an investigation. The High Court laid down that provisional attachment is a drastic and extraordinary power to be used sparingly and only on the basis of tangible material showing it is necessary to protect revenue. Attachment cannot be ordered mechanically or as a matter of course, and a cash-credit account, being a borrowing facility rather than the taxpayer's property, cannot be attached.

Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
Can my GST consultant attend a summons hearing on my behalf in Koyambedu?

I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?

What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Koyambedu manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Koyambedu buying stationery from an unregistered shop has no Section 9(4) liability at all.
Can I reduce GST for discounts given after the sale, like turnover incentives?
