Circular No. 167/23/2021-GST dated 17 December 2021 · 2021-12-17

Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.

Why this matters: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.

Goods transport agencies given the option to pay tax under forward charge

Annexure V to Notification No. 11/2017-Central Tax (Rate), inserted by Notification No. 03/2022-Central Tax (Rate) dated 13.07.2022 with effect from 18 July 2022 · 2022-07-13

From 18 July 2022 a goods transport agency may choose to pay tax itself instead of leaving it to the recipient under reverse charge. The option is exercised by filing a declaration in Annexure V with the jurisdictional officer before the financial year begins. Having opted in, the transporter charges tax on its own invoices, either at 5 per cent without input tax credit or at 12 per cent with full credit, and the recipient must not pay reverse charge on those bills.

Practical effect: Chennai manufacturers and traders must collect the Annexure V position of each transporter, because paying reverse charge on a forward-charge bill leads to a double payment that is hard to recover.

No second levy of IGST when goods leave a Free Trade Warehousing Zone

The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

What is the late fee if I file a nil return late?
For a nil GSTR-3B or nil GSTR-1 filed after the due date, the late fee is Rs.20 per day of delay (Rs.10 CGST plus Rs.10 SGST), capped at Rs.500 per return (Rs.250 plus Rs.250). No interest applies since there is no tax payable. While Rs.500 sounds small, defaults across several months add up, and the bigger cost is the compliance chain breaking and your GSTIN being flagged. Is ITC available on food, catering and canteen expenses for our factory staff?

How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Is GST applicable on rent for my shop or office premises?
Yes. Renting of commercial property such as shops, offices, godowns and industrial sheds is a taxable supply of services at 18 percent, charged by the landlord under forward charge once the landlord's aggregate turnover, including this rent, crosses Rs.20 lakh. The tenant, if registered and using the premises for business, can claim the GST as input tax credit, since renting is not a blocked credit. Landlords with several small commercial properties often cross the threshold without realising it, because rent from all properties on the same PAN is clubbed. A yearly turnover check protects against retrospective demands.
What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier. Missing fields make the invoice defective and can jeopardise your buyer's credit.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
