Following the 55th GST Council meeting, CBIC clarified disputed classifications: ready-to-eat salted popcorn is taxable at 5 per cent (12 per cent if pre-packaged and labelled) while caramelised popcorn falls at 18 per cent as sugar confectionery; autoclaved aerated concrete blocks with over 50 per cent fly ash content attract 12 per cent; and dried pepper supplied by an agriculturist remains exempt. Past periods were regularised on an as-is-where-is basis to prevent retrospective demands.

Tvl. Sri Hari Enterprises v. Assistant Commissioner (ST) (FAC) — Madras High Court, W.P. No. 17504 of 2025, decided 9 May 2025 (N. Mala J.) · 2025-05-09
An appeal filed beyond ninety days but within the further thirty days that the appellate authority may condone was rejected outright. The Madras High Court set aside that rejection and directed the taxpayer to represent the appeal along with a condonation of delay application, with the limitation to be reckoned from the original date of filing. The Court emphasised that procedure is the handmaid of justice and technical defects should not defeat substantive rights.
What to do about it: File the appeal even if you are past ninety days, and attach a properly supported condonation petition — rejection without considering it is challengeable.

The Council completed the fitment exercise for goods and broadly approved GST rates at nil, five, twelve, eighteen and twenty-eight per cent across the tariff, along with the rates of GST compensation cess to be levied on specified goods.
