Trade Profile and GST Jurisdiction for Small Street, Kundrathur

Kundrathur, below its hilltop Murugan temple, is a construction supply town where brick kilns, blue metal and sand dealers, granite yards and small fabrication shops line Kundrathur Main Road and the routes to Porur, Mangadu and Sriperumbudur. Brick manufacturers must choose between the special 6 per cent scheme without input tax credit and 12 per cent with credit, and every laden lorry crossing Rs.50,000 needs an e-way bill. That commercial character shapes the GST questions we see from Kundrathur every week — registrations, monthly returns, credit mismatches and departmental queries. We deliver GST Notice Reply for businesses in Kundrathur, and clients also reach us from Porur and Mangadu nearby. Documents move over WhatsApp, drafts are approved before filing, and a senior consultant reviews every submission, so distance from our office never dilutes the quality of the work.

GST jurisdiction for Kundrathur (PIN 600069): businesses here generally fall under the CGST Chennai Outer Commissionerate. We regularly represent clients from Kundrathur before this jurisdiction for registrations, clarifications and notice hearings, and can confirm your exact division and range from your GSTIN. State-jurisdiction cases are handled with the Tamil Nadu Commercial Taxes Department.
GST for Builders and Contractors in Kundrathur
Under-construction residential sales are taxed at 1 percent for affordable housing and 5 percent for other units, both without input credit, while commercial works contracts run at 18 percent with credit. Builders must procure at least 80 percent of inputs and input services from registered suppliers each year; any shortfall attracts tax under reverse charge, and cement bought from unregistered dealers is taxed under reverse charge at its full rate regardless of the shortfall test. Development rights and joint development agreements carry their own liability trigger points. A specialist runs the 80-20 computation annually and tracks reverse charge on cement and landowner area sharing so project costing stays accurate.
Yes, small businesses in Kundrathur can use professional GST Notice Reply affordably — fees start at Rs.2,999, which is usually far less than one period of late fees and lost input tax credit.
Why Us

Why Small Street, Kundrathur Businesses Choose ChennaiGST

Not a bulk-filing portal. A senior consultant knows your file, your jurisdiction and your deadlines.

Familiar with Chennai Jurisdictions and Officers' Expectations

We work with Chennai GST ranges and circles every week, including the jurisdiction covering Kundrathur. We know how local proper officers examine registrations, what supporting documents they routinely call for, and how to present a file so it moves without repeated queries.

No Handing Off to Untrained Juniors

Your work is executed by trained GST staff working under direct senior supervision, not passed to interns learning on your file. The person preparing your return understands reverse charge, blocked credits and place of supply, because getting these wrong costs you money.

Fast, Clean Registrations and Amendments

New GSTIN applications, core field amendments through REG-14, additional places of business — we prepare complete, query-resistant applications the first time. Clean paperwork is the difference between smooth approval and weeks lost answering clarification memos from the department.

Multi-GSTIN and Branch Coordination

Businesses with registrations in more than one State, or multiple branches under one PAN, face cross-charge, stock transfer and input service distribution questions that single-GSTIN firms never see. We keep all your registrations consistent with each other, not just compliant individually.

Experience Across Trades and Sectors

Traders, manufacturers, contractors, e-commerce sellers, professionals and service exporters — we have handled GST for all of them. Whatever mix of goods and services your Kundrathur business supplies, the rate, classification and place-of-supply questions have almost certainly crossed our desk before.

Ledger Housekeeping on the Portal

Your cash ledger, credit ledger and liability register are reviewed regularly, not just at filing time. Excess balances are flagged for use or refund, and where a genuine slip surfaces, a voluntary payment through DRC-03 settles it before it can mature into a notice.

How It Works

Our Notice Reply Process

Notice study

We read the notice line by line, identify the section invoked, the periods covered, the exact information sought and the deadline for response.

Data reconciliation

The figures alleged in the notice are reconciled against your filed returns, GSTR-2B and books, so the reply is grounded in verifiable numbers rather than assertions.

Reply drafting

We draft a professional, point-wise reply addressing every allegation, attaching reconciliations, invoices and legal support, and share the draft with you for approval.

Filing and payment

The approved reply is filed on the portal within the deadline. Where a small genuine liability exists, we advise payment through DRC-03 to limit interest and penalty.

Closure tracking

We monitor the portal for the officer's response, attend to any further queries or hearing dates, and pursue the matter until a closure or order is received.

Outcomes

What You Get

Practical outcomes our clients measure us by.

No Interest Outflows at 18 Percent

Interest on delayed GST payment runs at 18 percent per annum, which is costlier than most working capital finance. Timely computation and payment through our calendar keeps that meter permanently at zero.

Growth Without Compliance Anxiety

New branches, new product lines and interstate sales all carry GST consequences. With standing professional support, you expand knowing registrations, invoicing and returns will keep pace with the business.

Better Cash Flow Planning

You know your expected GST outflow days before the 20th, not on the night of filing. That advance visibility lets you plan payments, collections and bank balances instead of scrambling for funds at the deadline.

A Written Trail for Every Decision

Tax positions, rate choices and credit calls are documented as they are made, so if a question arises years later, the reasoning and evidence are on file rather than in someone's fading memory.

Marketplace Accounts That Stay Live

E-commerce platforms continuously validate seller GSTINs and filing status. A consistently compliant registration keeps your listings active and settlements flowing, with no sudden suspension of your online sales channel.

Due-Diligence Ready for Investors and Buyers

Funding rounds, partnerships and business sales all begin with a compliance check. A clean, documented GST history lets you clear that scrutiny quickly instead of watching a deal stall over old filing gaps.

Why a Specialist Matters

With ChennaiGST vs Doing It Yourself

AspectWith ChennaiGSTDIY / Unattended
When a notice arrivesA professional drafts the reply in the department's format and files it within the statutory window, such as thirty days for ASMT-11.You face departmental language alone, and a missed reply deadline can convert a simple query into a demand with penalty.
Supplier defaultsSuppliers who stop uploading invoices are identified within the period and pursued before their default becomes your blocked credit.Missing supplier invoices surface only when credit is denied, by which time recovering the amount from the vendor is difficult.
Annual return preparationMonthly reconciliations roll naturally into GSTR-9, filed comfortably before 31 December with figures already agreed through the year.Twelve months of unmatched data reconstructed in December, with differences discovered too late to be corrected cleanly.
Keeping up with changesRate changes, portal updates and new thresholds such as the Rs.5 crore e-invoice limit are tracked by us and applied to your case proactively.Changes are discovered after the fact — often through a rejected filing, a blocked e-way bill or a departmental letter.
Refund claimsRFD-01 filed with complete statements and annexures, tracked from ARN to bank credit, with any deficiency memo answered promptly.Incomplete claims bounce back as deficiency memos while the refund sits unclaimed for months and working capital stays blocked.
Goods in transitE-way bills generated correctly and matched to invoices, so consignments pass roadside inspections without detention or penalty.A defective or missing e-way bill can mean detention at a checkpoint, with penalties that dwarf the tax on the consignment.

Supreme Court: burden of proving genuineness of ITC transactions lies on the purchasing dealer

State of Karnataka v. Ecom Gill Coffee Trading (P) Ltd — Supreme Court, 2023 · 2023-03-13

Under Section 70 of the Karnataka VAT Act, the Supreme Court held that the dealer claiming input tax credit bears the burden of proving the transaction actually took place — producing invoices and payment by cheque is not enough. The dealer should establish the seller's particulars, actual movement of goods, freight and delivery details. Though a VAT ruling, GST officers routinely apply this standard while testing ITC claims in scrutiny and audits.

Why this matters: Maintain a complete evidence trail for every purchase — transport documents, e-way bills, weighment slips and payment proof — because invoices alone will not save ITC in a dispute.

AAR Ruling

Liquidated damages held taxable in early MAHAGENCO ruling

Maharashtra State Power Generation Co Ltd — AAR Maharashtra, Order No. GST-ARA-15/2017/B-30, dated 8 May 2018 (upheld by AAAR) · 2018-05-08

The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.

What to do about it: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.

Portal Advisory

Officers must give written grounds of arrest before arresting under GST

CBIC Instruction No. 01/2025-GST · 2025-01-13

Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.

What it means for you: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.

Already Holding the Notice? Read It in About a Minute

Upload the PDF to our free GST Notice Analyser. It identifies which of 34 notice types you have, pulls out the DIN, GSTIN and tax period, reads the reply date printed on the notice and tells you plainly whether that date has already passed — along with the documents and reconciliations you will need. No payment, no account. If the notice does not state a date we can read, it says so rather than guessing one for you.

Analyse my notice — free WhatsApp it to a consultant

The analyser reports what your notice says and the statutory position for that form. It is not a substitute for a consultant reading your actual records, and a reply should be reviewed before you file it.

FAQs

Frequently Asked Questions

Straight answers from practising GST consultants — based on the CGST Act, current CBIC notifications and day-to-day portal experience.

Which GST office handles Kundrathur businesses?
Businesses in Kundrathur (PIN 600069) generally fall under the CGST Chennai Outer Commissionerate, with state-jurisdiction cases handled by the Tamil Nadu Commercial Taxes Department. Your exact division and range can be confirmed from your GSTIN on the GST portal. We regularly appear before this jurisdiction for registrations, clarifications and hearings, so we know the local practice and documentation preferences.
How long does GST notice reply take in Kundrathur?
Draft reply in 3-5 working days. That assumes your documents are complete and there is no departmental query. We start the same day we receive your papers and tell you the realistic completion date upfront rather than an optimistic one. Where the GST portal or the officer causes delay — clarifications, physical verification or system issues — we track it daily and keep you informed on WhatsApp.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. If summons in a Kundrathur investigation escalate toward arrest talk, engage counsel immediately; call +91 - 9600 606 444 for coordination.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. Many Kundrathur taxpayers discover notices only after the order stage because they never checked the Additional Notices tab, so a quick portal review is the first step.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. For most small businesses a corrected fresh application is faster than an appeal. ChennaiGST reviews the rejection reasons first and then recommends the quicker route for your case.
The GST department has issued me a summons under Section 70. Is it serious?
Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. Never guess answers during a statement; ask for time to verify records instead. ChennaiGST prepares clients thoroughly before summons appearances; call +91 - 9600 606 444 for assistance.
I agree with part of the ASMT-10 discrepancy but not all of it. How do I respond?
A split response is perfectly acceptable and often the wisest course. Pay the portion you accept through Form DRC-03 with interest at 18 percent per annum, and in your ASMT-11 reply state the payment details along with a reasoned explanation for the balance, supported by reconciliations, invoices and ledger extracts. Paying the admitted amount voluntarily at the scrutiny stage avoids penalty on it under Section 73 and shows bona fides, which helps the officer accept your explanation on the disputed part. ChennaiGST prepares this admit-and-contest working for Kundrathur businesses so nothing is conceded unnecessarily; call +91 - 9600 606 444 to review your notice.
How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. Consistency matters more than frequency.
What are the exact steps to file a DRC-03 voluntary payment on the GST portal?
Log in and go to Services, then User Services, then My Applications, choose Intimation of Voluntary Payment DRC-03 and click New Application. Select the cause of payment, such as voluntary, show cause notice, audit or annual return, pick the section and financial year, and enter the tax, interest and penalty amounts head-wise under IGST, CGST and SGST. A saved draft remains available for fifteen days. Offset the amounts from your ledgers, sign with DSC or EVC, and download the ARN acknowledgement. Our Kundrathur office files DRC-03 the same day for clients; call +91 - 9600 606 444.
Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Distributor incentive schemes run from Kundrathur should be papered before the season starts, not after.
Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day. Transporters and suppliers can also be affected when a counterparty GSTIN is blocked. We clear return backlogs for businesses in Kundrathur on priority; call +91 - 9600 606 444.
We pay for foreign software subscriptions and overseas consultants. Is GST payable in India?
Yes. Import of services, meaning services from a supplier located outside India received by a person in India for business, attracts IGST under reverse charge in the recipient's hands, payable in cash and claimable as ITC if eligible. This catches cloud software, foreign professional fees, overseas advertising and licence fees. Two nuances matter: services from a related foreign party, such as your parent company, are taxable even without consideration under Schedule I, and OIDAR services supplied to unregistered consumers are taxed in the foreign supplier's own hands, not under RCM. Startups and IT firms in Kundrathur paying by card frequently miss these entries; reconcile foreign remittances against RCM paid annually.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Kundrathur godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
Is there really a penalty for not displaying my GST number at my shop?
Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty. Inspection teams visiting Kundrathur markets routinely check name boards first, so a few hundred rupees of signage is the cheapest compliance in the entire GST law.
How is GST charged on hotel room tariffs after the rate changes?
Hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, a reduction from the earlier 12 percent. Rooms priced above Rs.7,500 per day attract 18 percent with full input tax credit. The rate is determined by the actual transaction value charged for the room, so seasonal discounts can change the applicable rate on the same room across bookings. Lodges and hotels around Kundrathur should configure billing software to test the per-day value on each invoice rather than fixing one rate for the property.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Kundrathur on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
What documents are required for GST notice reply in Kundrathur?
For GST notice reply you will generally need: Copy of the notice received, with its reference number and date, GST portal login credentials, GSTR-1 and GSTR-3B filed copies for the periods in question, GSTR-2A and GSTR-2B data for the relevant periods, Sales and purchase registers for the periods covered. The exact list depends on your constitution — proprietorship, partnership, LLP or company — and on the specifics of your case. Send what you have on WhatsApp to +91 - 9600 606 444 and we will confirm within the same working day exactly what else is needed, so nothing is rejected later for a missing paper.
Can I get GST notice reply done online without visiting the office?
Yes, the entire process can be handled online. You share scanned documents on WhatsApp or email, we prepare and file everything on the GST portal, and you receive the acknowledgement and filed copies digitally. Businesses in Kundrathur regularly complete notice reply with us without a single office visit. If a physical verification or personal hearing is required by the department, we guide you through it.
Do you provide gst notice reply for small businesses and proprietorships in Kundrathur?
Yes. A large share of our clients in Kundrathur are proprietors, small traders, shop owners, freelancers and family businesses rather than large companies. The fee of Rs.2,999 and the process are the same regardless of size, and we explain the compliance position in plain language — in Tamil or English — so you understand what is being filed on your behalf and why.
