Jian International v. Commissioner of Delhi Goods and Services Tax — Delhi High Court, judgment dated 22 July 2020, reported at 2020 SCC OnLine Del 2606 · 2020-07-22

The refund application was neither processed nor returned with a deficiency memo in Form RFD-03 within the fifteen days allowed by Rule 90, and objections were raised only much later. The High Court held that if no deficiency memo is issued within fifteen days the application must be treated as complete and taken up for processing, and the department cannot keep raising fresh deficiencies afterwards. The refund was directed to be paid along with interest.

What to do about it: Diarise the fifteenth day after filing a refund application — silence beyond that date is a strong ground to press for payment.

CBIC explained the implementation of the retrospective ITC relaxations: for FY 2017-18 to 2020-21, credit claimed in GSTR-3B filed up to 30 November 2021 is valid, and taxpayers with confirmed demands on this sole ground must use the special rectification procedure rather than appeals where the order was not contested. It also clarified, following Section 150 of the Finance (No. 2) Act, 2024, that no refund arises for tax already paid or credit already reversed on this issue.

Practical effect: The 16(4) relief works only prospectively against pending or unpaid demands; amounts already paid or reversed cannot be recovered as refunds, so prioritise open cases.

The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. How is interest calculated on a GST demand or late payment?
Interest runs at 18 percent per annum under Section 50 on tax paid after the due date, computed day-wise from the day following the due date until payment.
