Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.

Practical effect: If a registration query asks for documents outside the prescribed list, cite this instruction in your REG-04 reply and escalate to the jurisdictional Commissioner if it persists.

Deem Distributors (P) Ltd v. Union of India — Telangana High Court, Writ Petition No. 7063 of 2021, decided 3 August 2021 · 2021-08-03

During a search and investigation the officers pressed the taxpayer to reverse credit and pay tax before any notice was issued. The High Court held that Section 74(5) merely gives the taxpayer an option to pay voluntarily; it does not empower officers to demand or coerce payment before a show cause notice. Raising a demand while the investigation is incomplete was held to be arbitrary and without jurisdiction, and refund of the amounts collected was directed.

Practical effect: You are not obliged to pay anything during a search or investigation; any payment should be a considered decision taken after advice, not on the spot.

37th GST Council Meeting, Goa — 20 September 2019 · 2019-09-20

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Madambakkam businesses, since no appeal is provided against DRC-22. How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. Freight from unregistered transporters and advocate fees are typical cases where businesses miss this paperwork.
What is the GST rate for restaurants and food delivery now?
Standalone restaurants, eateries and cloud kitchens charge 5 percent GST without input tax credit. Restaurants located in hotels where the room tariff exceeds Rs.7,500 per day fall in the specified premises category and charge 18 percent with input tax credit. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it. Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC.
