Reverse charge on sponsorship services

Entry 4, Notification No. 13/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

Sponsorship services supplied by any person to a body corporate or partnership firm located in the taxable territory were placed under reverse charge, so the sponsor paying for naming rights, event branding or team sponsorship had to discharge the tax. The entry has since been narrowed: on the recommendation of the GST Council at its 55th meeting, sponsorship services supplied by body corporates were moved to forward charge, leaving reverse charge to apply mainly where the sponsorship provider is not a body corporate.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

How do I handle GST when expired medicines are returned to the distributor?
CBIC Circular 72/46/2018 gives two routes for time-expired drugs. The return can be treated as a fresh supply by the person returning them, with a tax invoice if that person is registered, or the original supplier can issue a credit note under Section 34; the tax adjustment on a credit note is available only if it is reported within the statutory window, now 30 November following the financial year of supply. Where the manufacturer ultimately destroys the expired stock, input tax credit relating to the destroyed goods must be reversed under Section 17(5)(h). What happens if I miss filing GSTR-3B this month?
A late fee of Rs.50 per day (Rs.20 per day for a nil return) accrues automatically, capped based on your turnover, and interest at 18 percent per annum applies on tax paid late. You also cannot file the next period's GSTR-1 until the pending GSTR-3B is filed, since returns must be filed sequentially. If two consecutive tax periods remain unfiled, e-way bill generation gets blocked, and continued default can lead to suspension of your GSTIN. I made a mistake in GSTR-3B. Can I revise it?
No, GSTR-3B cannot be revised once filed. The GST law allows corrections only through adjustments in the returns of subsequent tax periods. If you under-reported tax, pay the difference with 18 percent interest in the next GSTR-3B or through Form DRC-03. If you over-reported, adjust it in a later month within the time limits allowed. How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Getting this right decides whether you charge CGST plus SGST or IGST, and a Madhavaram seller delivering to a Bengaluru buyer charges IGST because delivery terminates in Karnataka.
I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?

However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Madhavaram buying stationery from an unregistered shop has no Section 9(4) liability at all.
Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. For applications filed on the main portal, log in and use Services, then Track Application Status, choosing the module and entering the ARN, or open My Applications to see every application with its case detail folder, notices and replies in one place. Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
We sponsored a trade event. Does reverse charge apply to the sponsorship amount?
If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
