Resident welfare associations challenged the CBIC circular and AAR view that once monthly maintenance exceeds Rs 7,500 per member, GST applies on the entire amount. The Madras High Court held that the exemption operates up to Rs 7,500, and only the amount in excess of that threshold is taxable — the term 'up to' marks a clear slab. The circular's contrary interpretation was quashed as contrary to the exemption notification.
Why this matters: Chennai apartment associations collecting over Rs 7,500 per month per flat should charge GST only on the excess over Rs 7,500, relying on this jurisdictional ruling.
GSTN Advisory dated 1 November 2025 — simplified registration scheme under Rule 14A · 2025-11-01
GSTN operationalised the optional simplified registration scheme under Rule 14A of the CGST Rules from 1 November 2025. Applicants whose self-assessed output tax liability, across CGST, SGST, IGST and cess, does not exceed Rs 2.5 lakh per month can opt in while filing REG-01 and receive registration within three working days, subject to mandatory Aadhaar authentication of the primary authorised signatory and at least one promoter or partner.

Following the principal-agent circular, CBIC clarified the position of a del credere agent who guarantees payment by the buyer. Whether he is an agent under Schedule I again depends on whether he invoices the goods in his own name. Where he is not an agent and extends short-term credit to the buyer, the interest he charges is exempt as a supply of extending deposits or loans; where he is an agent, the interest forms part of the value of the supply of goods.
Why this matters: Agents who finance their buyers should document whether they invoice the goods themselves, since that determines whether the interest they collect is exempt or taxable.
