CBIC laid down a uniform procedure for interception of vehicles carrying goods. The officer issues a statement in FORM GST MOV-01, an order of inspection in MOV-02, records the inspection report in Part A of FORM GST EWB-03 within twenty-four hours and the final report in Part B within three days, and then releases the goods in MOV-05 or issues a detention order in MOV-06 with a notice in MOV-07. Confiscation follows in MOV-10 and MOV-11.

The window for taking the benefit of the capped late fee on pending GSTR-3B returns for July 2017 to April 2021 was extended from 31 August 2021 to 30 November 2021. Response to the scheme had been strong but many taxpayers, particularly those whose registrations had been cancelled for non-filing, could not complete the exercise in three months. The extension was announced together with the extension of the revocation deadline so that the two reliefs could be used in sequence.

The Supreme Court held that where a manufacturer reverses credit taken on inputs used in exempted goods, the position is as though no credit was ever taken. The exemption benefit therefore cannot be denied. Maintaining separate accounts is one method of compliance, but a debit entry reversing the credit achieves the same result. Substance rather than the form of book entries governs the outcome.
Practical effect: A Chennai business making both taxable and exempt supplies can protect its position by reversing the proportionate credit properly and documenting the reversal.
