A landowner obtained approval to develop agricultural land into residential plots and proposed to sell the plots after laying roads, drainage, water lines and other common facilities required by the plan sanction. The Gujarat Authority for Advance Ruling held that the sale price includes the value of development works, so the transaction is a taxable supply of construction service and not a bare sale of land. CBIC later clarified that sale of land after levelling, laying drainage lines and similar works is still sale of land under Schedule III and outside GST.
What to do about it: Plot developers should read the 2022 CBIC clarification alongside older adverse rulings before conceding GST on plot sales or on development charges.

A large batch of petitions challenged show cause notices issued under Section 74 for periods from 2021 onwards. The Madras High Court examined whether the jurisdictional facts of fraud, wilful misstatement or suppression of facts to evade tax must be set out in the notice itself, and held that the expression where it appears requires subjective satisfaction supported by material. A notice that does not specify those foundational facts suffers from a jurisdictional defect.
What to do about it: Where a Section 74 notice merely recites the statutory words without alleging specific suppression, challenge the invocation of the extended period at the outset.

CBIC explained the effect of the Supreme Court's order of 27 April 2021 extending limitation. The extension applies where an appeal has to be filed against a quasi-judicial order before the Joint or Additional Commissioner (Appeals), the Commissioner (Appeals), the Appellate Authority for Advance Ruling, the Tribunal or the courts, or where a revision or rectification of an order has to be sought. It does not apply to proceedings a taxpayer has to initiate or compliances he has to make, which remain governed only by the statute and by the notifications issued under section 168A of the CGST Act, nor to the quasi-judicial work of officers such as deciding refund claims, revocation applications and demand adjudications, which may continue.
What to do about it: A Chennai taxpayer who missed an appeal deadline during the pandemic waves can rely on this relief, but return filing dates were never covered by it.
