Tvl. Ranjini Enterprises v. State Tax Officer — Madras High Court (Madurai Bench), W.P.(MD) No. 5172 of 2024, decided 5 March 2024 (B. Pugalendhi J.) · 2024-03-05
A best-of-judgment assessment of about Rs 5 lakh was raised for non-filing of the April 2023 return, the dealer contending that the real liability was about Rs 2 lakh, which was paid once the assessment came to its notice. The Madras High Court permitted the dealer to file an application for condonation of the delay in filing the return and directed the State Tax Officer to consider that application sympathetically in the light of the Court's earlier precedent. The writ petition was disposed of on those terms without any order as to costs.
Practical effect: Where late returns have triggered adverse consequences, a formal condonation application supported by reasons is the correct first step in Tamil Nadu.
41st GST Council Meeting (video conferencing) — 27 August 2020 · 2020-08-27
The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.

Rule 37A, CGST Rules, 2017, inserted by Notification No. 26/2022-Central Tax · 2022-12-26
Rule 37A makes the buyer responsible where a supplier declares an invoice in GSTR-1 but fails to file the corresponding GSTR-3B by 30 September following the end of that financial year. The recipient must reverse the input tax credit availed on that invoice by 30 November of that year, failing which interest under Section 50 runs. If the supplier later files the return and pays tax, the recipient may re-avail the credit without any time limit.
Practical effect: Track supplier GSTR-3B compliance annually, reverse credit for defaulting suppliers by 30 November, and re-claim it once the supplier regularises.
