Circular No. 49/23/2018-GST dated 21 June 2018 · 2018-06-21

This circular modified the detention procedure. The expression three working days in the earlier circular was replaced by three days, and the release wording in FORM GST MOV-05 was corrected. Most importantly it reiterated rule 138C(2): once physical verification of goods in transit has been carried out at one place, no further physical verification of the same conveyance may be done anywhere in India unless specific information relating to tax evasion is made available subsequently.

The Council recommended nil GST on food preparation of millet flour in powder form containing at least 70 per cent millets by weight when sold loose, and 5 per cent when pre-packaged and labelled. GST on molasses was slashed from 28 per cent to 5 per cent to benefit sugarcane farmers and reduce cattle feed costs. The Council also clarified that job work services of converting barley into malt attract the concessional 5 per cent rate applicable to job work in relation to food products, and not 18 per cent.

Practical effect: Food processors and cattle-feed traders in Tamil Nadu gained significant input cost relief and needed to re-price millet-based products.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?

Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. Consistency matters more than frequency.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly.
