Resident welfare associations challenged the CBIC circular and AAR view that once monthly maintenance exceeds Rs 7,500 per member, GST applies on the entire amount. The Madras High Court held that the exemption operates up to Rs 7,500, and only the amount in excess of that threshold is taxable — the term 'up to' marks a clear slab. The circular's contrary interpretation was quashed as contrary to the exemption notification.

The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain.
