For GSTR-1 the fee was capped at Rs 500 for nil statements, Rs 2,000 where turnover is up to Rs 1.5 crore and Rs 5,000 where turnover is between Rs 1.5 crore and Rs 5 crore, with the normal Rs 10,000 ceiling continuing above Rs 5 crore. For the composition annual return in GSTR-4, from the financial year 2021-22 onwards, the fee was capped at Rs 2,000 in total, being Rs 1,000 each under the central and State laws, and at Rs 500 in total where the return is nil. For the tax deduction return in GSTR-7 the fee was reduced to Rs 50 per day subject to a ceiling of Rs 2,000.
Why this matters: Small Chennai taxpayers can no longer face runaway late fee running into lakhs, because every return type now carries an absolute ceiling.

The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.

A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. Circulars remain an aid to administration and can bind officers, but they cannot enlarge or restrict what the legislature has enacted.
Why this matters: Chennai businesses should treat CBIC circulars as useful administrative guidance, but should not rely on one that conflicts with the plain words of the GST Act.
