Garments moving from Tirupur to Tuticorin for export were detained because the e-way bill showed Chennai as the place of dispatch, and a penalty equal to 200 per cent of tax was levied under Section 129(1)(a). The Court quashed the penalty, holding that the goods were in fact covered by documents, that the error was typographical and easily correctable, that Section 126 forbids penalty for such minor breaches absent fraudulent intent, and that leaving the reply column blank breached Section 129(4).

What to do about it: A Tamil Nadu exporter penalised for a clerical mistake in the e-way bill, with no allegation of evasion, has a strong case for refund of the penalty paid under protest.

Hotel room GST restructured on transaction value and outdoor catering cut to 5 per cent

37th GST Council Meeting, Goa — 20 September 2019 · 2019-09-20

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

What it means for you: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Mangadu as urgent.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. What is compounding of offences under GST and how much does it cost?

Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Mangadu businesses, since no appeal is provided against DRC-22. How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. How will I know my scrutiny reply has been accepted by the GST officer?
If your explanation in ASMT-11 is found acceptable, the officer issues Form ASMT-12 informing you that the discrepancies stand explained and no further action is required on those points. Keep the ASMT-12 safely with your reconciliation working papers, because the same period can still come up in a later audit and the closure order is your best shield. When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
What is the GST rate for restaurants and food delivery now?
Standalone restaurants, eateries and cloud kitchens charge 5 percent GST without input tax credit. Restaurants located in hotels where the room tariff exceeds Rs.7,500 per day fall in the specified premises category and charge 18 percent with input tax credit. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it. Can my GST registration be cancelled for not filing returns?
