Implementing 55th GST Council decisions, CBIC clarified that penal charges levied by banks and NBFCs for breach of loan terms, which replaced penal interest per RBI directions, are not consideration for any service and attract no GST. It also clarified that RBI-regulated payment aggregators are covered by the exemption for settlement of transactions up to Rs 2,000, and addressed other service-tax positions, regularising past periods on an as-is basis.

Cancer drugs cut to 5 per cent; namkeens and savoury snacks cut to 12 per cent

The Council reduced GST on three cancer drugs — Trastuzumab Deruxtecan, Osimertinib and Durvalumab — from 12 per cent to 5 per cent. Extruded or expanded savoury snacks and namkeens were cut from 18 per cent to 12 per cent prospectively, aligning them with similar ready-to-eat namkeens, while un-fried snack pellets stayed at 5 per cent. The Council also brought roof-mounted package unit (RMPU) air conditioning machines for railways under 28 per cent and moved car seats from 18 per cent to 28 per cent.

It looks similar to a tax invoice but shows no tax rate or tax amount, and a composition dealer must print the words composition taxable person, not eligible to collect tax on supplies on it. What is the difference between a GST credit note and a commercial credit note?

A commercial or financial credit note adjusts only the money owed between the parties; it carries no GST, is not reported in returns, and leaves everyone's tax position untouched. Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider.
