The Supreme Court dismissed the department's SLP, enhanced costs payable to the taxpayer, and confirmed that tax evasion intent is essential before penalising technical e-way bill lapses.
Why this matters: If your consignment is detained for an expired e-way bill caused by genuine transit delays, contest the penalty — courts require proof of intent to evade, not just the lapse.

Acting on the GST Council's decision at its 23rd meeting in Guwahati, this notification restructured the rate on restaurant, eating joint, mess and canteen services. From 15 November 2017 the rate became 5 per cent with the express condition that no input tax credit on goods and services used in supplying the service may be taken. Restaurants located in hotels where the declared tariff of any unit of accommodation was seven thousand five hundred rupees or more continued at 18 per cent with full input tax credit.
Practical effect: A standalone Chennai restaurant charges 5 per cent and must write off all GST on rent, equipment and ingredients as a cost, since no credit is allowed.

Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.
What it means for you: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.
