The taxpayer filed GSTR-3B late and paid interest only on the net cash portion of the tax. The High Court held that on the language of Section 50 as it then stood, interest ran on the gross liability, because input tax credit is credited to the ledger only when the return is filed. The decision caused wide concern in trade, and Parliament later amended Section 50 with retrospective effect from 1 July 2017 to charge interest only on the cash component in most late-return cases.
Why this matters: For late returns, interest is now generally computed on the cash portion only — if an older notice demands interest on gross tax, rely on the retrospective proviso to Section 50.

The Council decided that all taxpayers would file GSTR-3B with payment of tax by the 20th of the succeeding month until March 2018, and that for GSTR-1 taxpayers would be divided by turnover. Those with annual aggregate turnover up to Rs 1.5 crore would file GSTR-1 quarterly, and those above that figure monthly, with a detailed table of due dates. Filing of GSTR-1 was to continue without requiring GSTR-2 and GSTR-3 for the previous period.

It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.
Why this matters: Chennai food manufacturers selling instant mixes should confirm whether the product is a plain flour or a preparation before applying 5 percent.
