Notification No. 09/2022-Central Tax · 2022-07-05

This notification brought into force, with retrospective effect from 1 July 2017, the Finance Act, 2022 amendment to Section 50(3) of the CGST Act. Interest at eighteen per cent is now chargeable only where input tax credit has been wrongly availed and utilised, and not where it has merely been availed and reversed without being used to discharge output tax. The effective rate on wrongly utilised credit is eighteen per cent, against the twenty-four per cent that had applied under the earlier provision. Rule 88B, inserted by Notification No. 14/2022-Central Tax of the same date, prescribes how utilisation is to be measured.

In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise.
