This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.

Supreme Court confirms input tax credit is a statutory concession subject to conditions

Jayam & Co v. Assistant Commissioner — Supreme Court, (2016) 15 SCC 125, judgment dated 22-09-2016 · 2016-09-22

Considering Section 19(20) of the Tamil Nadu VAT Act, which required reversal of credit where goods were sold below purchase price, the Supreme Court held that input tax credit is a form of concession granted by the statute. The legislature can therefore attach conditions and restrictions to it. However, the Court held the reversal provision could operate only prospectively from the date it was introduced, and not for earlier periods.

What is the general penalty under Section 125 and when is it imposed?

Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
How is GST charged on clothes and footwear after the rate change?
The rate now turns on a per-piece price line of Rs.2,500. Apparel, made-up textile articles and footwear with a sale value up to Rs.2,500 per piece attract 5 percent GST, while pieces priced above Rs.2,500 attract 18 percent. If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. How do I register my DSC on the GST portal, and why does the emSigner error keep appearing?
After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal.
