Instead, tax is payable at the time of issue of the invoice, or when the invoice ought to have been issued, under section 12(2)(a). CBIC confirmed that the death of a sole proprietor, where the business is continued by the successor, is a transfer of business for the purposes of section 18(3), so the unutilised input tax credit can be transferred to the transferee through FORM GST ITC-02. The successor must first obtain a new registration, the cancellation application for the deceased's registration is filed selecting death of proprietor as the reason, and the transferee accepts the credit on the portal.

Yes, within limits.
