The Supreme Court held that a rule prescribing a period within which credit must be taken from the date of the invoice does not take away any vested right. It merely regulates the manner and time of availing the credit, which the legislature is entitled to do. A taxpayer who fails to take the credit within the prescribed window loses the benefit. This reasoning supports the time limit in Section 16(4) of the CGST Act.

The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.
Practical effect: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.

Rule 21A(2A) was inserted to allow the officer to suspend a registration immediately, without first giving an opportunity of being heard, where a comparison of the returns with the outward supply statement or with suppliers' data shows significant differences or anomalies indicating contravention. The taxpayer is intimated in Form GST REG-31 and must explain the discrepancies. Rule 21 was simultaneously expanded to add fresh grounds of cancellation, including availing credit in violation of Section 16 and breaching Rule 86B.
What to do about it: A Chennai GSTIN can be suspended overnight on a system-generated mismatch, so a REG-31 intimation must be answered within the time allowed rather than ignored.
