Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.

Thirumalakonda Plywoods v. Assistant Commissioner (ST) — Andhra Pradesh High Court, 2023 · 2023-07-18
The Andhra Pradesh High Court upheld the constitutional validity of Section 16(4) CGST Act, which bars availment of input tax credit after the prescribed deadline, holding that ITC is a conditional concession and the time limit is neither violative of Articles 14, 19 or 300A nor overridden by the non-obstante acceptance of a belated return with late fee. Parliament subsequently granted relief through Section 16(5), retrospectively extending the deadline for FY 2017-18 to 2020-21 up to 30 November 2021.
What to do about it: Claim every invoice's ITC well before the annual cut-off; for old years, check whether the retrospective Section 16(5) window and its amnesty procedures cure your late claims.
Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018
The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.
Practical effect: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.
