The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

The Council announced an amnesty scheme reducing late fee on pending GSTR-3B returns for the tax periods from July 2017 to April 2021. For taxpayers with no tax liability in those periods the late fee was capped at Rs 500 per return, and for others at Rs 1,000 per return, in each case counting central and state tax together. The reduced late fee applied only where the returns were furnished between 1 June 2021 and 31 August 2021, a window later extended to 30 November 2021.
How we apply it: Taxpayers who cleared four years of pending returns in this window paid a fraction of the statutory late fee, which is why acting promptly in an amnesty window matters so much.
Rule 86B, CGST Rules, 2017, inserted by Notification No. 94/2020-Central Tax · 2020-12-22
Rule 86B, effective 1 January 2021, bars a registered person whose taxable turnover in a month exceeds Rs 50 lakh from discharging more than ninety-nine per cent of the output tax liability for that month from the electronic credit ledger. At least one per cent must come from cash. Exemptions apply where the proprietor, managing director or partners have paid more than Rs 1 lakh as income tax in each of the last two years, or where a large refund has been received on exports or an inverted duty structure.
Why this matters: A Chennai business billing above Rs 50 lakh a month cannot run purely on credit and must budget for a minimum cash outgo each month unless it fits an exemption.
