A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18

The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.

Circular No. 136/06/2020-GST dated 3 April 2020 · 2020-04-03

CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. Freight from unregistered transporters and advocate fees are typical cases where businesses miss this paperwork.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Otteri godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
