47th GST Council Meeting, Chandigarh — 28 and 29 June 2022 · 2022-06-29

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.

The Supreme Court held that a High Court should not decline to hear a writ petition merely because a statutory appeal is available, particularly where the challenge raises a pure question of law or jurisdiction and no disputed facts need investigation. Where the foreign affiliate raises no invoice for the service, the value may be treated as nil, and that nil value is deemed the open market value. No demand can then be raised on a notional cost allocation.

Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. For most small businesses a corrected fresh application is faster than an appeal. ChennaiGST reviews the rejection reasons first and then recommends the quicker route for your case.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Verify the computation, pay only what is truly due, and contest the balance in Part B with reasons. ChennaiGST routinely trims DRC-01A figures for clients before payment.
How will I know my scrutiny reply has been accepted by the GST officer?
If your explanation in ASMT-11 is found acceptable, the officer issues Form ASMT-12 informing you that the discrepancies stand explained and no further action is required on those points. The order appears in your Additional Notices and Orders tab on the portal. Keep the ASMT-12 safely with your reconciliation working papers, because the same period can still come up in a later audit and the closure order is your best shield. If instead the officer is not satisfied, expect a DRC-01A or show cause notice. Many Padi clients receive ASMT-12 within weeks when the reply is complete and well-annexed.
I received an ASMT-10 scrutiny notice for my Padi business. What exactly is it?
ASMT-10 is a notice issued under Section 61 after the officer scrutinises your filed returns and finds discrepancies, such as differences between GSTR-1 and GSTR-3B, excess ITC compared with GSTR-2B, or turnover gaps against e-way bill data. It is not yet a demand; it is an opportunity to explain. You must respond in Form ASMT-11 within thirty days, either justifying each discrepancy with reconciliations or accepting the liability and paying through DRC-03. A well-documented ASMT-11 usually closes the matter with an ASMT-12 acceptance order. Scrutiny notices are common among Padi traders, so respond seriously but without panic.
When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
My footwear shop sells chappals at Rs.300 and shoes at Rs.4,000 on the same bill. How do I invoice this?
One invoice can comfortably carry both rates. Each pair is tested against the Rs.2,500 sale-value threshold independently, so the chappals are billed at 5% and the Rs.4,000 shoes at 18%, as separate line items under their footwear HSN codes in Chapter 64. Your GSTR-1 HSN summary will then show turnover split across the two rates. Ensure the billing software picks the rate from the item price automatically rather than from a fixed product master, because the same article sold at different price points can legitimately fall in different slabs. Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies. It covers aerated waters, caffeinated and other sugary carbonated beverages, large cars beyond the small-car specifications, motorcycles above 350cc, yachts, personal aircraft, and specified actionable claims such as betting, casinos and online money gaming. Pan masala and tobacco products continue under their earlier levy structure until the compensation cess obligations are discharged, after which they move to the 40 percent rate as notified. If your business deals in any of these lines, pricing and working capital need careful planning.
I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
