The Supreme Court read down the ITC block in Section 17(5)(d) CGST Act for construction of immovable property. It held that the phrase 'plant or machinery' differs from the defined 'plant and machinery', and whether a building qualifies as a 'plant' must be decided case by case using a functionality test — for example, a shopping mall built essentially to supply renting services could qualify, allowing input tax credit on its construction.

Circular No. 107/26/2019-GST of 18 July 2019 had sought to classify certain information technology enabled services, and in particular back-office support supplied to overseas clients, in a way that could treat the Indian supplier as an intermediary and deny export status. After representations from the industry, CBIC withdrew that circular ab initio, so it is treated as never having been issued.
What it means for you: Chennai back-office and BPO units should ensure no notice relies on the withdrawn ITeS circular; the governing guidance is now Circular 159/15/2021 on intermediaries.

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.
What to do about it: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.
