CBIC clarified that an Indian advertising agency dealing with a foreign client on a principal-to-principal basis is not an intermediary merely because it books media space from Indian publishers. The target audience in India is not the recipient of the service; the foreign client who pays is the recipient. Such services are therefore neither intermediary services nor performance-based services, and qualify as export of services when the other conditions of Section 2(6) of the IGST Act are met.
What to do about it: Chennai advertising, media buying and marketing agencies serving overseas clients can supply under LUT and claim refunds, resisting the intermediary label.

This notification designated www.gst.gov.in, managed by the Goods and Services Tax Network, as the Common Goods and Services Tax Electronic Portal for registration, payment of tax, and furnishing of returns. It gives legal status to the portal, which matters because the CGST Act and Rules repeatedly require documents to be filed electronically on the common portal rather than in paper form with a jurisdictional office.
Why this matters: Filings made anywhere other than the notified portal have no legal effect, so a Chennai business cannot discharge a return obligation by emailing or hand-delivering a return to the department.

The applicant promoted the products of overseas manufacturers in India and also carried out installation, commissioning and after-sales support for Indian customers, billing the foreign principal in convertible foreign exchange. The Karnataka Authority for Advance Ruling held that this activity facilitates the supply between the foreign principal and the Indian customer, making the applicant an intermediary. The place of supply is therefore in India and the receipts do not qualify as export of service.
