The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.
What to do about it: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.
41st GST Council Meeting (video conferencing) — 27 August 2020 · 2020-08-27
The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.
What to do about it: The borrowings arranged here are why compensation cess continued to be collected on cess goods long after the five-year compensation period ended in June 2022.

The Supreme Court held that a tax is not per se a restriction on the freedom of trade and commerce guaranteed by Article 301 of the Constitution. Only a discriminatory tax that favours local goods over goods from other States is hit. The judicially created concept of compensatory tax was discarded as having no constitutional basis.
