The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.

Where an officer had passed a best-judgment assessment order under Section 62(1) on or before 28 February 2023 because a taxpayer failed to file returns, the order was deemed withdrawn if the taxpayer furnished the valid return by 30 June 2023 (extended to 31 August 2023) along with interest under Section 50 and late fee under Section 47.
