What the department must do before assessing a non-filer to best judgment

Circular No. 129/48/2019-GST dated 24 December 2019 · 2019-12-24

CBIC prescribed a uniform procedure for non-filers. A system-generated reminder goes out three days before the due date, followed by a notice in FORM GSTR-3A after the due date giving fifteen days to file. If the return is still not filed, the officer may assess the liability to the best of his judgment under section 62 and issue an order in FORM GST ASMT-13. That order is deemed withdrawn if the taxpayer files the valid return within thirty days of service.

What it means for you: An ASMT-13 best-judgment order is not the end; filing the missing return within the statutory window from service makes it fall away automatically.

The Finance (No. 2) Act 2024 inserted Section 16(5) retrospectively, allowing ITC for financial years 2017-18 to 2020-21 if it was claimed in a GSTR-3B filed on or before 30 November 2021, even though it breached the original Section 16(4) deadline. Section 16(6) gives similar relief for returns filed after revocation of a cancelled registration. Where demands were already confirmed on this ground, a special rectification procedure was notified for taxpayers to have such orders corrected. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total.
