The appellate authority had rejected refund claims for August and September 2017 on the basis of a departmental circular. The Madras High Court set aside that rejection, holding that Section 54(3) of the GST Act permits an exporter to opt either for duty drawback or for refund of accumulated input tax credit, and that a circular cannot override the statutory provision. The authority was directed to process the refunds within six weeks.

It sought exemption on the footing that this was renting of residential accommodation. This notification appointed 1 July 2017 as the date on which the remaining provisions of the Central Goods and Services Tax Act, 2017 came into force, that is, all the sections not already notified by Notification 01/2017-Central Tax. From this date the levy under section 9, the input tax credit provisions, the return, payment, refund, assessment, audit, demand and appeal machinery all became operative.
