The writ petition was disposed of on those terms without any order as to costs.

Dynamic QR code made compulsory on B2C invoices of large suppliers

Notification No. 14/2020-Central Tax · 2020-03-21

Registered persons with aggregate turnover above Rs 500 crore were required to print a dynamic quick response code on invoices issued to unregistered consumers, so that the customer could scan and pay digitally. Where the payment is made through a prescribed dynamic QR code, the cross-reference of that payment on the invoice is treated as compliance. The same exclusions as e-invoicing apply. The start date was pushed from 1 April 2020 to 1 October 2020 and then to 1 December 2020.

What to do about it: Only very large retailers are covered, so an ordinary Chennai shop or restaurant has no dynamic QR code obligation on its cash-counter bills.

Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. Delayed GSTR-1 also hurts your customers, because your invoices miss their GSTR-2B and their input tax credit gets deferred, which can strain business relationships. Filing by the 11th every month avoids both the cost and the friction.
My bank account was debited for a GST challan but the cash ledger shows nothing. What do I do?
This is a payment-communication failure between the bank and the portal, and the prescribed remedy is Form PMT-07, filed under Services, then Payments, then Grievance against Payment. Quote the CPIN, bank name and debit details; the system takes up the discrepancy with the bank, and the amount either credits your ledger once the bank confirms, or is re-credited to your account if the transaction failed. I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
What counts as exempt supply when calculating my ITC reversal ratio?
Exempt supplies for Rules 42 and 43 include nil-rated and wholly exempted supplies, and by virtue of Section 17(3) also cover outward supplies on which your recipient pays tax under reverse charge, transactions in securities valued at one percent of sale value, and sale of land or completed buildings valued at stamp duty value. Importantly, interest earned on deposits, loans or advances is excluded from the exempt turnover for this computation for everyone except banking companies and financial institutions. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise.
