46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31
The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.
Practical effect: Textile traders in Chennai and across Tamil Nadu continued at five per cent from January 2022, but footwear moved to twelve per cent, so the two sectors diverged from that date.

Where the liability declared in GSTR-1 for a tax period exceeds the liability paid through GSTR-3B beyond the prescribed limit, the system issues an intimation in Form GST DRC-01B. The taxpayer must either pay the difference with interest through Form DRC-03 or file a reply in Part B of DRC-01B explaining the reasons, within seven days. If no action is taken, the next GSTR-1 cannot be filed.

Notification No. 63/2020-Central Tax · 2020-08-25
This notification brought into force, with effect from 1 September 2020, the amendment to Section 50 of the CGST Act made by the Finance (No. 2) Act, 2019. The amendment provides that where a return is filed late, interest is charged only on that portion of the tax liability which is discharged in cash through the electronic cash ledger, and not on the part settled from input tax credit. Because it was made effective only prospectively, it caused considerable litigation over earlier periods.
Practical effect: For any delayed GSTR-3B, interest should be computed on the cash component alone, and a gross-liability interest demand should be challenged.
