Co-owners had let a residential building to a company that ran it as a hostel for students and working professionals. The advance ruling authorities denied exemption on the view that the lessee was using the property commercially. The High Court disagreed and held that leasing residential premises used as a hostel falls within Entry 13 of the IGST services exemption notification, since that entry does not require the lessee itself to occupy the premises as a residence. The Supreme Court dismissed the State's appeals on 4 December 2025 and confirmed that the end use as a residence, not the intermediate commercial layer, decides the question.

Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

What it means for you: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?

The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Beyond that, the demand becomes recoverable. Several traders in Pammal have faced bank account attachment for ignored GSTR-3A notices, so act within the fifteen-day window.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?

At what amount of tax evasion can GST prosecution be launched?

Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Track every submission with an acknowledgment, because the commencement date and the timeline arguments may matter later if disputes arise.
What documents do GST audit officers usually ask for?
Expect to produce the GSTR-1, GSTR-3B and GSTR-9 filings for the audit years, audited financial statements, trial balance, sales and purchase registers, ITC ledgers with supplier-wise detail, fixed asset register, e-way bill data, bank statements, key customer and vendor agreements, stock records and reconciliations between books and returns. Officers in Tamil Nadu commonly probe ITC on blocked credits under Section 17(5), reverse charge compliance, classification and rate issues, and turnover differences with income tax filings. Preparing a reconciliation file before submission lets you spot and voluntarily correct issues through DRC-03, which is far cheaper than an audit objection. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
What are the current GST rate slabs after the GST 2.0 changes?
From 22 September 2025, following the 56th GST Council meeting, India moved to a simplified two-slab structure: a merit rate of 5 percent and a standard rate of 18 percent. The earlier 12 percent and 28 percent slabs were abolished. A special 40 percent rate applies to a short list of luxury and demerit goods, while the concessional rates of 3 percent on gold and silver and 0.25 percent on rough diamonds continue. Is GST payable on hostel or paying guest accommodation in Pammal?

Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning.
