In a case arising from detention of goods, the Supreme Court held that a writ petition against a GST order is ordinarily not maintainable when an effective alternate remedy of statutory appeal exists. Writ jurisdiction is reserved for exceptional situations — breach of fundamental rights, violation of natural justice, excess of jurisdiction, or a challenge to the vires of the statute. The taxpayer was relegated to the appellate remedy.

What to do about it: File the statutory appeal within limitation instead of rushing to the High Court — reserve writ petitions for clear natural justice or jurisdictional violations.

Air conditioning machines, refrigerators, freezers and other refrigerating equipment, household and other dishwashing machines, vacuum cleaners, television sets including LCD and LED sets, computer monitors, set top boxes and projectors all sit in Schedule II at nine per cent central tax, giving eighteen per cent combined, from 22 September 2025. These goods had carried twenty-eight per cent since 2017, so the reduction of ten percentage points was the largest single consumer benefit of GST 2.0.

Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
What discrepancies usually trigger a GST scrutiny notice?
The frequent triggers are: tax declared in GSTR-1 exceeding tax paid in GSTR-3B; ITC claimed in GSTR-3B exceeding credit available in GSTR-2A or GSTR-2B; e-way bill turnover higher than reported outward supplies; missing reverse charge payments on transport, legal or import services; ITC not reversed on exempt supplies under Rules 42 and 43; and mismatches with TDS credits reported by government deductors in GSTR-7. Most of these are explainable through timing differences, credit notes or amendments, provided the reply maps each rupee of difference. An annual reconciliation habit prevents the majority of these notices for Pammal businesses.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.

Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste.
