The Maharashtra appellate authority held that penal interest and cheque bounce charges collected by a finance company from borrowers who delayed instalments are consideration for tolerating an act and are liable to GST at 18 per cent. CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.
What to do about it: If you collect late payment penalties from customers, check whether the charge sits inside the main contract before deciding to levy GST on it.

Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.

Exercising the COVID-related power under Section 168A, the Government extended the deadline for issuing orders under Section 73(10) to 31 December 2023 for FY 2017-18, 31 March 2024 for FY 2018-19 and 30 June 2024 for FY 2019-20. Because the show cause notice must issue three months before the order date, the notice deadlines shifted correspondingly. This notification is the legal foundation for the large wave of 2017-20 demand notices that followed.
What it means for you: Check the date of any 2017-20 demand order against these extended limits, since orders passed beyond them are time-barred and can be challenged on that ground alone.
