This circular made four significant changes. Refund claims cannot be bunched across financial years. Refund of accumulated credit on account of an inverted duty structure is not available where the inversion arises only because the rate on the same goods was reduced over time, since input and output are the same. Refund of tax paid on supplies other than zero-rated is repaid proportionately in cash and credit. Most importantly, refund of accumulated credit is restricted to invoices actually reflected in the applicant's GSTR-2A, and HSN or SAC must be shown in Annexure-B.

What to do about it: Refund working papers must now tie back to GSTR-2A invoice by invoice, and traders whose stock simply became cheaper cannot claim an inverted-duty refund.

This notification amended Notification 08/2017-Central Tax (Rate) to extend the exemption from reverse charge on intra-State supplies received by a registered person from an unregistered supplier, moving the end date from 31 March 2018 to 30 June 2018. It was the first of several extensions granted while the Government considered how to redesign section 9(4) rather than let it revive in its original sweeping form.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Why this matters: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Yes. The refund is computed proportionately using the formula in Rule 89(4), based on your export turnover versus total turnover. Which grocery items in my kirana shop attract 5% GST as pre-packaged goods?
Since 18 July 2022, specified food items such as rice, wheat, atta, pulses and flours attract 5% GST when sold in pre-packaged and labelled packs up to 25 kilograms, that is, packs bearing declarations required under the Legal Metrology Act. The same items sold loose, or in bulk packs above 25 kilograms, remain exempt.
