Dealing with Section 19(11) of the Tamil Nadu VAT Act, the Supreme Court held that input tax credit is a concession created by statute and not an absolute or constitutional right. The legislature may impose conditions, including a time limit for claiming it, and such a limit is mandatory rather than directory. A dealer who claims credit after the prescribed period loses it. This reasoning is routinely applied to Section 16(4) of the CGST Act.

The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Since 1 January 2019, security services by way of supply of security personnel provided by any person other than a body corporate to a registered person fall under reverse charge, so your business pays the 18 percent directly and claims credit. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry. I paid my supplier only part of the invoice within 180 days. How much ITC do I reverse?
The reversal is proportionate. If you paid sixty percent of the invoice value including tax within 180 days, you reverse only the ITC attributable to the unpaid forty percent, reporting it in Table 4(B)(2) of the GSTR-3B for the tax period immediately following the expiry of the 180 days. Amounts settled through book adjustments, such as netting off mutual dues or debit notes for quality deductions reducing the payable, have been accepted as payment in advance rulings, so a properly documented ledger adjustment protects the credit. Retention money held under contract terms is the most common trigger we see in Park Town construction and job-work businesses.
How many digits of the HSN code must I print on my tax invoices?

Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion.
